Embezzlement charge dropped against Coast HOA treasurer, but investigation not over

A Jackson County Court judge dismissed an embezzlement charge against the former treasurer of the homeowner’s association for Harbor Landing Apartments, though the case remains under criminal investigation.

Judge Mark Watts dismissed the felony charge against Kevin Lavon Nailer on March 9.

The dismissal followed a request from Nailer’s attorney, Tyler Cox, to do so because of a “lack of necessary witnesses available to testify,” at the preliminary hearing, thus resulting in a lack of probable cause to bind the case over to a grand jury for indictment.

Despite the decision by Watts to drop the initial charge, Jackson County Sheriff John Ledbetter said “our investigators are working with the District Attorney’s Office and plan to present the evidence to a grand jury to determine if there will be an indictment in the case.”

Nailer had been arrested Feb. 11 after a member of the homeowner association reported the alleged theft.

Nailer’s attorney addressed the ongoing investigation.

“I look forward to the sheriff’s department continuing its investigation because it will result in finding that Mr. Nailer didn’t do anything wrong,” Cox said.
