An Alabama man was hit by a van at a MS Coast casino. Now he and his wife are suing.
An Alabama couple is suing the Island View Casino and one of its employees after a van accident near the business last month.
Gerald LaMay of Mobile, Alabama, claims he suffered broken ribs, a lacerated liver, lung issues and other significant injuries when he was hit by the vehicle on May 5, 2023. Lamay and his wife, Malinda, filed suit last week in U.S. District Court.
The LaMays say in the suit they were invitees of the Gulfport, Mississippi casino when they had a comped dinner at the Beach Blvd Steamer Restaurant, which is adjacent to the main casino. After dinner, they started walking back to the Island View around 5:59 p.m.
As they were crossing east to west on 33rd Avenue in Gulfport, Gerald LaMay says he was hit by a Ford van driven by Island View employee Karen Monroe. “Suddenly, negligently, carelessly, recklessly, and without warning, defendant Monroe struck plaintiff Gerald LaMay with the front of the” van, the lawsuit reads.
“The defendants’ negligence has directly caused the plaintiffs to have already incurred significant medical treatment and expenses, and plaintiffs can reasonably expect to incur such treatment and expenses in the future,” the lawsuit says.
The LaMays are asking for unspecified damages for past, present and future medical expenses, and any other damages the might be proven at trial.
A lawsuit represents only one side of a legal argument. As of Tuesday, Island View and Monroe had not responded to the suit.
