A D'Iberville man accused in the car-crash death of his mother has been extradited to Jackson County to face a murder charge.

Jackson County Sheriff Mike Ezell said Marshall Austin Smith, 25, was returned to Jackson County on Friday after serving a sentence in Rankin County for violating his probation in another case.

Smith was arrested on a murder charge near St. Martin in August after he crashed a car while fleeing D'Iberville police. His mother, Millicent Sue Smith, 45, was in the car with him and was killed when it crashed into a tree.

At the time, he was on probation for a burglary in Harrison County and the arrest put him back in prison.

D'Iberville police had responded to a report of a fight among several people at a restaurant on Central Avenue. Officers learned a man, believed to be Marshall Smith, had rammed a vehicle when he drove away from the restaurant, Ezell said.

When officers attempted to arrest Smith he drove off, nearly hitting two police cars with their blue lights activated.

He headed into Jackson County, where he lost control, ran off the road and hit a tree between Brittany Avenue and St. Martin Road, officials said.

Authorities determined he had stolen the car from his mother, who later found her son at the restaurant and was in the car with him when he left its parking lot.

A trial date has not been set.
