Mistrial declared in sex crimes trial of Pascagoula man

PASCAGOULA -- A jury could not reach a unanimous verdict in the sex crimes trial of a Pascagoula man.

On Tuesday night, the jury informed the court it was hopelessly deadlocked. Circuit Judge Kathy King Jackson declared a mistrial.

A Jackson County grand jury had indicted David Henry Epps in 2015 on 11 counts of sexual battery and eight counts of touching of a child for lustful purposes. However, he was being tried on four counts of sexual battery and three counts of touching of a child for lustful purposes.

Epps is accused of fondling and having sex with a child under age 14 between August 2011 and April 2012.

A hearing is set for later in the week because the District Attorney's Office plans to retry the case. At the hearing, the new trial date is expected to be set.

At the time of Epps' arrest in April 2012, he lived on Edna Street in Pascagoula.
