STATE OF MISSISSIPPI COUNTY OF HARRISON NOTICE OF SUBSTITUTED TRUSTEE'S SALE WHEREAS, on the 9th day of December, 2005, Ted Rice and Phyllis L. Rice, as Grantors, executed and delivered a Deed of Trust to Charles N. Parrot, Trustee for Regions Bank, Beneficiary, conveying to the Trustee certain real property situated in Harrison County, Mississippi, and being more particularly described in said Deed of Trust; that same was given to secure a Promissory Note described therein, which Deed of Trust was recorded on December 19, 2005 as Instrument 2005 13744 T-J2, in the records of the Chancery Clerk of the 2nd Judicial District of Harrison County, Mississippi; as assigned by that certain Assignment of Security Instrument by Regions Bank in favor of RREF RB ACQUISITIONS, LLC which Assignment of Security Instrument was recorded on March 15, 2013 as Instrument 2013 934 T-J2, in the records of the Chancery Clerk of the 2nd Judicial District of Harrison County, Mississippi; and as further assigned by that certain Assignment of Security Instrument by RREF RB ACQUISITIONS, LLC in favor of RREF RB SBL-MS, LLC which Assignment of Security Instrument was recorded on January 30, 2014 as Instrument 2014 298 T-J2 in the records of the Chancery Clerk of the 2nd Judicial District of Harrison County, Mississippi, WHEREAS, the said Deed of Trust provides that the owner and holder of the indebtedness secured thereby may substitute and appoint a Trustee in the place and stead of the one named therein and that said Substituted Trustee shall have all the powers vested in and obligations imposed upon the original Trustee; and WHEREAS, RREF RB SBLMS, LLC, Beneficiary, is the owner and holder of said indebtedness, and did name, constitute, and appoint James Rebarchak as Substitute Trustee in said Deed of Trust in the place and stead of Charles N. Parrot, via that certain Appointment of Substitute Trustee recorded on March 3, 2014 as Instrument 2014 552 T-J2, in the records of the Chancery Clerk of the 2nd Judicial District of Harrison County, Mississippi; and WHEREAS, default was made and now exists in the payment of the indebtedness secured by said Deed of Trust; and WHEREAS, RREF RB SBLMS, LLC, as owner and holder of said Deed of Trust and the indebtedness secured thereby has exercised the option contained in said Deed of Trust and declared the entire indebtedness secured thereby immediately due and payable, and have called upon the undersigned Substituted Trustee to execute the trust therein contained, and requested that the undersigned Substituted Trustee sell said property under the provisions of the Deed of Trust for the purpose of satisfying the debt thereby secured and unpaid, together with attorney's fees and the expenses for the execution of this trust and of the selling of said property. NOW, THEREFORE, I, the undersigned Substituted Trustee, James Rebarchak, do hereby give notice that on the 30th day of July, 2014 during the legal hours between 11:00 A.M. and 4:00 P.M., I will proceed to sell at public auction, at public outcry, to the highest bidder for cash at the main front door of the Harrison County 2nd Judicial District Courthouse, 730 Dr. Martin Luther King, Jr. Boulevard, Biloxi, MS 39530 the following described property with all improvements located thereon, now owned by TED RICE (also known as R.T. RICE, DDS) and PHYLLIS L. RICE, and situated in Harrison County, Mississippi, and more particularly described as follows, to-wit: Lot one (1), Block one (1), Beauvoir Park Subdivision, Biloxi, Harrison County, Mississippi, as per map ro plat thereof on file and of record in the office of the Chancery Court of the Second Judicial District of Harrison County, Mississippi, LESS AND EXCEPT the following described Parcel: COMMENCING at the Southwest corner of said Lot 1 and run easterly along the South property line of said Lot 1 a distance of 114.2 feet to a point of the new West right-ofway of Beauvoir Road and the POINT OF BEGINNING, thence run northerly along said new West right-of-way a distance of 92 feet to the North property line of said Lot 1, thence run easterly along the eastward projection of said North property line a distance of 13.3 feet to the old West right-of-way of Beauvoir Road, thence run southerly along said old West, right-ofway a distance of 94.18 feet to the eastward projection of the South property line of said Lot 1, thence run westerly along said eastward projection a distance of 16.8 feet to the new West right-of-way and the POINT OF BEGINNING. TOGETHER WITH that certain easement across the following described property, said easement being more particularly described in instrument recorded in Deed Book 131 at Page 608 records of the Chancery Clerk of the Second Judicial District of Harrison County, Mississippi: Lot two (2), Block one (1), Beauvoir Park Subdivision, Biloxi, Harrison County, Mississippi, as per map or plat thereof on file and of record in the office of the Chancery Clerk of the Second Judicial District of Harrison County, Mississippi.
