Jury asks for transcripts; judge denies them

HATTIESBURG -- A jury deliberating in the Harrison County jail trial asked for the transcript of Rick Gaston's testimony and that of the two former Baldwin County corrections officers.

Attorneys objected to the use of transcripts because they are considered "real time" transcripts, which are not edited and could contain errors.

U.S. District Judge Louis Guirola Jr. agreed, saying the transcripts, well over 100 pages, "are not verbatim and could have errors."

He said the court will not provide them.

"It is not as though they are asking for a specific portion," he said.

Guirola said in jury instructions that the transcripts would not be available.

The judge sent them a note back which read, "Please continue your deliberations."
